Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Lucky Rhino, Inc. ("Company," "we," "us," or "our") governing your use of the Lucky Rhino Connector app (the "App") available on the BigCommerce Marketplace and in the Shopify  App Store.

By accessing or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms and conditions, please do not use the App.

1. Acceptance of Terms

1.1. By using the App, you acknowledge and agree to comply with these terms and conditions, as well as our Privacy Policy available at https://www.luckyrhino.com/copy-of-privacy.

2. Use of the App

2.1. The App is provided for the purpose of facilitating ecommerce transactions on the BigCommerce platform in the United States of America. You may use the App in accordance with its intended purpose and the terms outlined in this Agreement.

3. Intellectual Property

3.1. All intellectual property rights in the App, including but not limited to trademarks, copyrights, and patents, are owned by Lucky Rhino, Inc. You may not copy, modify, reproduce, distribute, or reverse engineer any part of the App.

4. Data Privacy

4.1. Your use of the App is subject to our Privacy Policy, which governs the collection and use of your personal information. By using the App, you consent to the practices described in the Privacy Policy. https://www.luckyrhino.com/privacy

5. Disclaimer of Warranty

5.1. The App is provided "as is" without any warranties, express or implied. We do not guarantee the accuracy, reliability, or availability of the App.

6. Limitation of Liability

6.1. To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any bugs, viruses, or other harmful code that may be transmitted to or through the App; (d) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

7. Termination

7.1. We reserve the right to terminate or suspend your access to the App at our discretion, without notice and for any reason, including for violation of this Agreement.

8. Governing Law

8.1. This Agreement shall be governed by and construed in accordance with the laws of Minnesota.

9. Changes to the Agreement

9.1. We reserve the right to update or modify this Agreement at any time. Any changes will be effective immediately upon posting the revised Agreement on http://www.luckyrhino.com/termsandservices. Your continued use of the App after any changes to this Agreement will constitute your acceptance of such changes.
